These Terms and Conditions govern access to and use of VitaMercado, including purchases made through our website. Please read them carefully before placing an order.

In these Terms, “VitaMercado”, “we”, “us” and “our” refer to the individual business identified above. “Customer”, “you” and “your” refer to the person using the website or purchasing products from us.
2. Scope and Acceptance
These Terms apply to use of the VitaMercado website, customer accounts, orders and contracts for the sale of goods. They form part of the agreement between you and VitaMercado together with our Privacy Policy, Shipping & Payment, Refund and Returns Policy and Cookie Policy.
Where mandatory consumer-protection law gives you rights that cannot legally be excluded or limited, those rights remain unaffected.
3. Eligibility to Purchase
You must have legal capacity to enter into a purchase contract. By placing an order, you confirm that the information you provide is accurate, complete and current, and that you are authorised to use the selected payment method.
Certain products may be subject to age, destination, quantity, import or other legal restrictions. We may request information reasonably necessary to verify eligibility or comply with applicable law.
4. Customer Accounts
You may be able to purchase as a guest or create a customer account. You are responsible for maintaining the confidentiality of your login details and for activity performed through your account.
Please notify us promptly if you believe your account has been accessed without authorisation. We may suspend or close an account where reasonably necessary for security, legal compliance, fraud prevention or a serious breach of these Terms.
5. Product Information and Availability
We aim to provide accurate product names, descriptions, images, specifications, quantities and availability information. Images are illustrative and colours or packaging may appear differently depending on the device, manufacturer updates or regional packaging.
Product availability may change without notice. Adding an item to the basket does not reserve it. If an ordered item becomes unavailable, we will contact you and may offer a suitable alternative where permitted. You may decline the alternative and request cancellation of the affected item.
Customers must review product information, labels, instructions, warnings and suitability before use.
6. Prices, Taxes and Currency
Product prices and the applicable currency are displayed on the product page and during checkout. Shipping charges, taxes and other mandatory costs, where applicable and known to us, are shown before the order is submitted.
We may correct obvious pricing, currency, tax or description errors. If an error affects an order already submitted, we will contact you before proceeding. You may accept the corrected amount or cancel the affected order for a full refund.
Your card issuer or bank may apply currency-conversion or international-transaction fees. These charges are determined by your financial institution and are not controlled by VitaMercado.
7. Order Process and Contract Formation
- You select products and add them to your basket.
- You review your basket, delivery information, price, currency, shipping charges and available payment methods.
- You submit the order and authorise payment.
- We send an electronic acknowledgement confirming that we received the order.
- A binding sales contract is formed when we expressly accept the order or dispatch the goods, whichever occurs first.
An automatic order acknowledgement does not necessarily mean that the order has been accepted. We may refuse or cancel an order for legitimate reasons, including product unavailability, an obvious pricing error, failed payment, suspected fraud, sanctions or export restrictions, inability to deliver, or legal and regulatory requirements.
If we cancel an order after receiving payment, we will initiate a refund for the cancelled amount using the applicable refund process.
8. Payments
Available payment methods are displayed during checkout and may vary by country, currency, order value, device and technical availability. Depending on the checkout configuration, these may include PayPal, supported credit or debit cards, bank transfer or another clearly identified payment method.
Online payments may be processed by PayPal, Stripe or another independent payment service provider. Payment information is transmitted using secure and encrypted technology. Where a payment provider hosts or processes the payment interface, payment data is handled under that provider's own terms and privacy practices. VitaMercado does not receive or store full card numbers when hosted or tokenised payment technology is used.
By submitting payment, you authorise the applicable payment provider and your financial institution to process the transaction, including any authentication required by law, the provider or card-network rules.
A payment may be authorised, declined, reversed or held for review by the payment provider, card issuer or bank. VitaMercado does not control approval decisions made by those organisations.
9. Payment Security, Fraud Prevention and Order Verification
To protect customers, VitaMercado and payment partners, orders may be screened using automated and manual fraud-prevention measures. We may request reasonable additional information to verify the purchaser, billing details, delivery details or payment authorisation.
We may delay, decline or cancel an order where verification cannot be completed, where information appears inconsistent, or where there is a reasonable concern involving fraud, unauthorised payment, sanctions, abuse, chargeback risk or unlawful activity.
Verification decisions do not remove your statutory rights. Personal data used for security checks is handled as described in our Privacy Policy.
10. Shipping, Dispatch and Delivery
Available delivery destinations, estimated delivery periods, shipping methods and charges are described in our Shipping & Payment and displayed during checkout where applicable.
Delivery dates are estimates unless we expressly agree to a guaranteed service. Delays may occur because of carrier operations, customs controls, weather, public holidays, incorrect address information, exceptional demand or events outside our reasonable control.
Customers must provide a complete and accurate delivery address. Additional costs resulting from an incorrect, incomplete or inaccessible address may be charged where permitted by law.
When tracking is available, we will provide tracking information electronically. Risk in the goods transfers as required by applicable consumer law.
11. International Orders, Customs and Import Restrictions
Customers placing international orders are responsible for ensuring that the products may legally be imported, possessed and used in the destination country. Customs authorities may inspect, delay, restrict or refuse shipments.
Import VAT, customs duties, handling fees and local charges may be payable by the recipient unless checkout clearly states that such charges are included. VitaMercado does not control charges imposed by public authorities or carriers.
We may restrict products, quantities or destinations where required for legal, safety, export-control, sanctions, carrier or compliance reasons.
12. Order Cancellation
Contact customer support as soon as possible to request cancellation. We cannot guarantee cancellation after an order has entered processing or dispatch.
Consumers in the European Economic Area may have a statutory right to withdraw from certain distance contracts within 14 days, subject to legal exceptions. Exceptions may include sealed goods that are unsuitable for return for health-protection or hygiene reasons once unsealed, personalised goods, and goods liable to deteriorate or expire rapidly.

13. Returns, Defective Goods and Refunds
Our separate Refund and Returns Policy explains:
- the return window;
- eligible and excluded products;
- how to request a return;
- the return address and return method;
- who pays return shipping;
- the process for damaged, defective, incorrect or missing items;
- inspection and refund timelines;
- the payment method used for refunds.
Approved refunds are generally issued to the original payment method unless another method is required or agreed. Processing time after we initiate a refund may depend on PayPal, Stripe or another payment provider, the payment method, card network and the customer's bank.
Nothing in these Terms limits mandatory legal remedies available for defective or non-conforming goods.
14. Discount Codes, Promotions and Gift Offers
Promotions may be subject to separate conditions, including validity dates, eligible products, minimum spending requirements, customer or country restrictions, and limits on use. Unless stated otherwise, only one promotional code may be used per order.
Promotions have no cash value and cannot be applied retrospectively. We may withdraw or correct a promotion affected by error, misuse or fraud, without affecting orders already validly accepted where the law requires otherwise.
15. Acceptable Use of the Website
You must not:
- use the website for unlawful, fraudulent or abusive purposes;
- attempt unauthorised access to accounts, systems or data;
- introduce malware, harmful code or automated traffic that disrupts the website;
- scrape, copy or commercially exploit website content without permission;
- submit false reviews, false information or unauthorised payment details;
- interfere with website security or checkout functionality.
16. Intellectual Property
The VitaMercado name, branding, website design, text, graphics, software, databases and original content are owned by or licensed to VitaMercado and are protected by applicable intellectual-property laws.
Product names, trademarks and images belonging to manufacturers or other rights holders remain the property of their respective owners. Limited personal use of the website does not transfer any ownership rights.
17. Disclaimers and Limitation of Liability
We exercise reasonable care in operating the website and fulfilling accepted orders. However, we do not guarantee that the website will always be uninterrupted, error-free or free from circumstances outside our reasonable control.
To the fullest extent permitted by law, VitaMercado is not liable for indirect or unforeseeable losses, loss of opportunity, or losses caused by customer misuse, inaccurate customer information, unauthorised account access caused by the customer, customs action, or failure to follow product instructions.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where applicable, or mandatory consumer rights.
18. Privacy and Cookies
We process personal data in accordance with our Privacy Policy. Information about cookies and similar technologies is available in our Cookie Policy.
Payment providers, delivery companies, fraud-prevention providers and other service providers may process information necessary to complete an order, subject to applicable data-protection law and their respective responsibilities.
19. Governing Law and Consumer Disputes
These Terms and contracts concluded through VitaMercado are governed by the laws of Poland, without depriving consumers of mandatory protections granted by the law of their country of residence where such protections apply.
Before starting formal proceedings, please contact our customer service team so that we can attempt to resolve the issue. Consumers may also use any competent consumer-protection or alternative dispute-resolution body available under applicable law.
Courts and authorities with jurisdiction under applicable consumer and procedural law may hear disputes.
20. Changes to These Terms
We may update these Terms to reflect changes in law, payment methods, business operations, security requirements or website functionality. The current version will be published on this page with its effective date.
Changes do not normally affect contracts already formed unless required by law or expressly agreed.
